1. Applicability
These Terms and Conditions apply to all services provided by me (hereafter “the Freelancer”) to the Client. By commissioning services or paying an invoice, the Client agrees to these Terms & Conditions.
Any other terms or general conditions used by the Client are hereby explicitly rejected unless otherwise agreed in writing.
2. Services & Quotations

Any offer, proposal or quotation is non-binding unless explicitly stated otherwise.

A quotation is valid for a period of 30 days from issuance, unless stated otherwise.

Services commence only after written acceptance of the quotation and receipt of any agreed deposit.
3. Changes / Subcontracting

As Freelancer I may — at my discretion — carry out (part of) the work myself or subcontract parts of the work to trusted third parties.

The Client will always be informed of subcontracting, and the Freelancer remains fully responsible for delivery, quality and confidentiality.
4. Delivery, Ownership & Handover

The final delivered product (website, design, code, assets) becomes the Client’s property after full payment.

Until full payment, the Freelancer retains all intellectual property rights, including rights to design drafts, source code, and unused assets.

The Freelancer reserves the right to showcase the work in his portfolio (unless otherwise agreed in writing).
5. Payment Terms

Payment is due within 14 days after invoice date, unless otherwise specified in the quotation.

In case of late payment, the Freelancer is entitled to charge statutory interest and collection costs.

Additional work beyond the agreed scope is billed separately.
6. Warranty & Liability

The Freelancer delivers services with due care and expertise but does not guarantee that the website will meet specific business results (e.g. ranking, customers, conversions).

The Freelancer is not liable for indirect damage, loss of profit or other consequential damage.

Liability is limited to the amount paid by the Client for the relevant project.
7. Client Responsibilities
The Client agrees to:

deliver requested information, content and feedback in a timely manner;

guarantee that all content provided is free from third-party rights;

approve final deliverables before publication and check compatibility before going live;

indemnify the Freelancer against any claims related to content or third-party materials provided by the Client.
8. Confidentiality & Privacy
Both parties agree to keep confidential all non-public business information exchanged during the project.
Personal data processed during the collaboration will be handled in compliance with applicable data protection laws (e.g. GDPR).
9. Termination

Either party may terminate the agreement in writing with 14 days notice.

In case of termination, the Client pays for all work delivered until that moment.

If the Client cancels the project after payment of a deposit, the deposit remains non-refundable.
10. Governing Law & Dispute Resolution

Dutch law applies to all agreements and disputes.
-
Any dispute not resolved amicably will be submitted to a competent court in the Netherlands.
11. Amendments
These Terms and Conditions may be amended by the Freelancer at any time. The most recent version will always be published on this site. Clients who previously agreed to the terms will be informed.
